Compression Ignition (Diesel) Engines

If you intend to install a diesel engine (also known as a compression ignition internal combustion engine) and this engine was ordered after July 11, 2005 and manufactured after April 1, 2006 and is not a fire pump engine, then the engine is subject to federal New Source Performance Standards (NSPS) found under 40 CFR 60 Subpart IIII. This regulation can be found at:

This federal NSPS also applies to diesel engines that are modified or reconstructed after July 11, 2005. For fire pump engines, the federal NSPS applies to engines ordered after July 1, 2006 that are manufactured as a certified National Fire Protection Association (NFPA) fire pump engine.

Spark Ignition (Gasoline, Natural Gas, etc.) Engines

If you intend to install a gasoline engine or other type of spark ignition engine and this engine was ordered after June 12, 2006 and manufactured on or after the dates on the table below, the engine is subject to federal New Source Performance Standards (NSPS) found under 40 CFR 60 Subpart JJJJ (Subpart JJJJ). This regulation can be found at:

This federal NSPS also applies to spark ignited engines that are modified or reconstructed after June 12, 2006.

Although a specific application for engines subject to Subpart JJJJ has not yet been developed, the applicant must obtain a permit for these engines that meet the requirements of 40 CFR 60, Subpart JJJJ.

The Division recommends that the applicant uses this form and use the manufacturer’s emission factors to estimate the emissions from the engine.

The Division will evaluate the application to ensure that the engine meets the requirements of 40 CFR 60, Subpart JJJJ and will be permitted to comply with the NSPS standards if the application is approved.
